This Agreement is between PacificWing Detailing ("PacificWing," "we") and the customer identified below ("Customer," "you"). By signing below or approving a written quote that references these terms, you agree to the following for all detailing services on the aircraft identified below (the "Aircraft").
1.Services and Quote
We will perform the services described in our written quote or booking confirmation. The quote identifies the services, the starting price, and the final quoted price for your aircraft type and condition. Work outside the quote requires your approval before we begin.
2.Pre-Service Walk-Around and Pre-Existing Conditions
Before work begins, we conduct a documented walk-around of the Aircraft, including photographs, and note visible pre-existing damage or wear. You (or your representative) are invited to participate. PacificWing is not responsible for pre-existing damage or conditions, whether or not noted, including but not limited to: existing scratches, dents, hail damage, corrosion, filiform, paint oxidation, chips or delamination; crazing, hazing, or scratches in acrylic windows; loose, brittle, or previously repaired trim, seals, placards, antennas, fairings, or de-ice boots; worn, stained, torn, or sun-damaged interior surfaces; and any prior non-standard repairs.
3.Customer Representations
You represent and agree that: you own the Aircraft or are authorized by the owner to order services on it; you have disclosed any special coatings (ceramic, PPF, recent paint under 90 days, experimental finishes), de-ice boot treatments, open squawks, or fragile or non-standard components we should know about; you will remove or secure valuables, documents, and loose items from the Aircraft before service; the Aircraft will be electrically safe for cleaning (master off, pitot heat off) and positioned where agreed with ramp or hangar access arranged; detailing is a cosmetic service only — it is not an inspection, maintenance, or airworthiness service, and nothing we do or report substitutes for a preflight inspection or required maintenance.
4.Our Standard of Care
We use aviation-appropriate products and practices, including masking or protecting static wicks, pitot tubes, static ports, angle-of-attack sensors, and antennas before applying product; acrylic-safe window care; and no leaning of equipment on the airframe. We photograph our work before and after each job.
5.Damage Claims and Limitation of Liability
(a) Claims window: you will inspect the Aircraft at completion (we encourage a joint walk-around) and report any claimed damage in writing within 48 hours of completion and before the Aircraft's next flight, whichever comes first. We must be given a reasonable opportunity to inspect claimed damage before any repair is performed. (b) We are responsible for direct physical damage to the Aircraft to the extent caused by our negligence while performing services. (c) To the maximum extent permitted by law, PacificWing is not liable for: pre-existing conditions (Section 2); damage resulting from conditions you did not disclose under Section 3; ordinary results of proper cleaning on aged or deteriorated surfaces; loss of or damage to items left in the Aircraft; or indirect or consequential damages of any kind, including loss of use, diminution in value, hangar or ferry costs, or lost charter or rental revenue. (d) Except where prohibited by law, our total liability for any claim is limited to the proceeds actually paid by our insurance for that claim or, if no insurance proceeds are paid, to the amount you paid for the service giving rise to the claim. Nothing in this Agreement limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under California law.
6.Insurance
PacificWing will carry commercial general liability insurance, including hangarkeepers / care, custody and control coverage, at the time services are performed. A certificate of insurance is available on request.
7.Payment, Scheduling, and Weather
Payment is due on completion unless the quote states otherwise. Quotes assume safe access to the Aircraft at the scheduled time; waiting time or re-mobilization caused by access issues may be billed at our posted hourly rate after notice to you. Either party may reschedule for weather or airport operational restrictions without penalty with reasonable notice. Cancellations with less than 24 hours' notice may incur a fee of up to 25% of the quoted service.
8.Photographs
We take before/after photographs of every job for quality records and claims documentation. We may use photographs that do not identify the registration number for marketing.
9.General
This Agreement is governed by California law. The parties will first attempt in good faith to resolve any dispute directly; either party may then bring the dispute in small claims court or, above that limit, in the courts of Orange County, California. If any provision is held unenforceable, the remainder stays in effect. This Agreement plus the written quote is the entire agreement for the services.
